Any community, be it in real or virtual world, cannot function smoothly without some rules and regulations. youcreateonline.com (henceforth referred to as “YCO” or “Site”) community is no exception. When you join this community, whether as a contributor/member or a reader or just a browser (all referred to as “you” or “your” in the rest of the document), you agree to abide by the terms set forth in this “Terms of Use”. It is your responsibility, as a contributor/member or just as a reader to read, review and accept these Terms of Use, Privacy Policy and Cookie policy, before proceeding to the Site. If you do not agree with any of the terms listed, or referenced below, please desist from accessing the Site. By accessing the Site you agree to be bound by all of the terms and conditions of this Terms of Use.
This Terms of Use is a legal agreement between you and Ra-Ha Udyam LLC registered in the Commonwealth of Pennsylvania, USA.
Overview
YCO is made available to you by Ra-Ha Udyam LLC. All references like, “we”, “us” and “ours” on the “site” refer to Ra-Ha Udyam LLC only. The services – contents, tools, information etc. are offered to you subject to your agreeing to work within the boundaries defined in Terms of Use referenced here. In case of inconsistency between the terms described here and any additional terms or policies appearing in documents referenced here, the terms and conditions in the latter will be in force.
We reserve the right to update or make changes in these Terms of Use. On receiving the information of such an update, it will be your responsibility to read and review the updated Terms of Use. Your continued use of the site, post the update, will be construed as your acceptance to the updated Terms of Use and other guidelines and policies.
Any breach or violation of any of the Terms of Use will result in immediate suspension/termination of your account without any notice.
Creating an Account
All are welcome to browse and read the contents on the site. However, to participate in discussions through comments on our site, or to submit your creation/s for publication, signing-up on youcreateonline.com is required.
For participating only in the commenting and discussions, you will need to sign up as a “Member” using basic login information – username and password.
To be able to submit your creations for publication, signing up as a “Contributor” is required. For this, you will first have to sign up on youcreateonline.com and then provide some additional information using a Google Form provided on the site for this purpose.
Both Member and Contributor are also referred as “User” or “Account” in this document, and other documents defining various policies of youcreateonline.com
Since you are responsible for all the activities recorded in your account, it is imperative for you to keep your username and password secure, and not share it with anyone, lest someone misuses it to your detriment. If you suspect that your username and/or password have been compromised, notify us (xxx@YCO.com)) immediately.
Policies of the site
A User must, during registration process, provide correct information requested and should update such information, when required, to maintain registration and profile information current, accurate and complete.
False or inaccurate information, if provided knowingly, will give us the right to suspend or terminate your account and/or restrict your access to the site.
General Terms
The site is meant for sharing literary creations of various genre and it should be accessed for this purpose. Access to the site should not be used for illegal, unauthorized or malicious (transmission of worms, viruses or code of destructive nature etc.) purpose.
The contents of the site are solely for your personal use. No part or portion of the site and its contents should be reproduced, duplicated, copied, transmitted, published or sold, either in its original or re-engineered form, without express written consent from the copyright owner.
The Work You Submit
The work you submit, User-Generated Content (“UGC”), in any form (text, video, image etc.) to YCO for publication must be original (not already copyrighted by someone else or some other entity) and authored/created by you. YCO considers plagiarism, passing off someone else’s work without full acknowledgement, as your own, highly unethical. Submission of plagiarised work or plagiarised parts in your submission, without proper credit to the original author, will be a reason for rejection of the work for publication. Submission of plagiarised contents three times will result in termination of your Contributor status on the site. We may warn you, but are not obligated to do so, before we terminate your Contributor status on the site.
If an infringement of copyrighted material is identified on our site in any UGC, our response and action will be in keeping with Digital Millennium Copyright Act 1998 (available on US Copyright Office website). (click here for details)
If a User’s content is removed from the site because of a DMCA notification that YCO receives, the user will be informed about it, and from there the User can take steps, like sending a counter notice, as the User deems fit.
“Contributor” will retain the copyright of all the UGC submitted by the Contributor. If YCO gets information about any of contributor’s work being published in a form which can be considered as a copyright violation, YCO will forward the information to the Ccontributor to take appropriate actions with the publisher of the Contributor’s copyrighted material.
By submitting content, either through our site or through social media hashtags, contributor give us the permission to publish your work online to YCO and other sites. For including creation in print media, YCO will approach the Contributor for permission, and will publish in print media only when the permission is received.
All UGC received will be reviewed and approved by our editorial committee before it is accepted for publication. The committee will conduct the review with due diligence, and its decision will be final.
Editorial committee will assess the suitability of contents for YCO. The contributor should use due diligence for grammatical, spelling, typographical correctness of the document. Submissions lacking this, may be returned to the contributor for correction.
Even though submitted work is reviewed for is suitability for publication in YCO, the Contributor will be solely responsible for the correctness, authenticity, propriety, integrity, veracity and need for confidentiality of the content.
YCO is meant for contents for entertainment/enjoyment of the readers and, hence, the UGCs and comments, should be in good taste and not disturb harmonious atmosphere of the community. UGC should be devoid of unlawful, obscene, vulgar, personally attacking (defamatory, threatening, abusive, harassing etc.), Controversial and Judgmental contents, unsubstantiated claims/information – as judged by our editorial committee. Broadly, “Controversial and Judgmental” will include, contents involving, but not limited to, discrimination (any sort), extreme views (racial, religious, ethnical, political or any other), personal attacks contents, propaganda, etc.
It is impossible to list all situations and types that may be deemed unacceptable. The list above, however, provides a range of unacceptable characteristics but may not be all inclusive. In such situations, the decisions and actions of YCO will be final and binding.
